Article 1 This Law is enacted to protect patent rights for inventions-creations, to encourage invention-creation, to foster the spreading and application of inventions-creations, and to promote the development and innovation of science and technology, for meeting the needs of the construction of socialist modernization.
第二條 本法所稱的發明創造是指發明、實用新型和外觀設計。
Article 2 In this Law, "inventions-creations" mean inventions, utility models and designs.
第三條 國務院專利行政部門負責管理全國的專利工作；
Article 3 The patent administration department under the State Council is responsible for the patent work throughout the country.
統一受理和審查專利申請，依法授予專利權。
It receives and examines patent applications and grants patent rights for inventions-creations in accordance with law.
省、自治區、直轄市人民政府管理專利工作的部門負責本行政區域內的專利管理工作。
The administrative authority for patent affairs under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government are responsible for the administrative work concerning patents in their respective administrative areas .
第四條 申請專利的發明創造涉及國家安全或者重大利益需要保密的，按照國家有關規定辦理。
Article 4 Where an invention-creation for which a patent is applied for relates to the security or other vital interests of the State and is required to be kept secret, the application shall be treated in accordance with the relevant prescriptions of the State.
第五條 對違反國家法律、社會公德或者妨害公共利益的發明創造，不授予專利權。
Article 5 No patent right shall be granted for any invention-creation that is contrary to the laws of the State or social morality or that is detrimental to public interest.
第六條 執行本單位的任務或者主要是利用本單位的物質技術條件所完成的發明創造為職務發明創造。
Article 6 An invention-creation, made by a person in execution of the tasks of the entity to which he belongs, or made by him mainly by using the material and technical means of the entity is a service invention-creation.
職務發明創造申請專利的權利屬於該單位；
For a service intention-creation, the right to apply for a patent belongs to the entity.
申請被批準後，該單位為專利權人。
After the application is approved, the entity shall be the patentee.
非職務發明創造，申請專利的權利屬於發明人或者設計人；
For a non-service invention-creation, the right to apply for a patent belongs to the inventor or creator.
申請被批準後，該發明人或者設計人為專利權人。
After the application is approved, the inventor or creator shall be the patentee.
利(li)用(yong)本(ben)單(dan)位(wei)的(de)物(wu)質(zhi)技(ji)術(shu)條(tiao)件(jian)所(suo)完(wan)成(cheng)的(de)發(fa)明(ming)創(chuang)造(zao)，單(dan)位(wei)與(yu)發(fa)明(ming)人(ren)或(huo)者(zhe)設(she)計(ji)人(ren)訂(ding)有(you)合(he)同(tong)，對(dui)申(shen)請(qing)專(zhuan)利(li)的(de)權(quan)利(li)和(he)專(zhuan)利(li)權(quan)的(de)歸(gui)屬(shu)作(zuo)出(chu)約(yue)定(ding)的(de)，從(cong)其(qi)約(yue)定(ding)。
In respect of an invention-creation made by a person using the material and technical means of an entity to which he belongs, where the entity and the inventor or creator have entered into a contract in which the right to apply for and own a patent is provided for, such a provision shall apply.
第七條 對發明人或者設計人的非職務發明創造專利申請，任何單位或者個人不得壓製。
Article 7. No entity or individual shall prevent the inventor or creator from filing an application for a patent for a non-service invention-creation.
第八條 兩個以上單位或者個人合作完成的發明創造、一yi個ge單dan位wei或huo者zhe個ge人ren接jie受shou其qi他ta單dan位wei或huo者zhe個ge人ren委wei托tuo所suo完wan成cheng的de發fa明ming創chuang造zao，除chu另ling有you協xie議yi的de以yi外wai，申shen請qing專zhuan利li的de權quan利li屬shu於yu完wan成cheng或huo者zhe共gong同tong完wan成cheng的de單dan位wei或huo者zhe個ge人ren；
Article 8. For an invention-creation jointly made by two or more entities or individuals, or made by an entity or individual in execution of a commission given to it or him by another entity or individual, the right to apply for a patent belongs, unless otherwise agreed upon, to the entity or individual that made, or to the entities or individuals that jointly made, the invention-creation.
申請被批準後，申請的單位或者個人為專利權人。
After the application is approved, the entity or individual that applied for it shall be the patentee.
第九條 兩個以上的申請人分別就同樣的發明創造申請專利的，專利權授予最先申請的人。
Article 9. Where two or more applicants file applications for patent for the identical invention-creation, the patent right shall be granted to the applicant whose application was filed first.
第十條 專利申請權和專利權可以轉讓。
Article 10. The right to apply for a patent and the patent right may be assigned.
中國單位或者個人向外國人轉讓專利申請權或者專利權的，必須經國務院有關主管部門批準。
Any assignment, by a Chinese entity or individual, of the right to apply for a patent, or of the patent right, to a foreigner must be approved by the competent department concerned of the State Council.
轉讓專利申請權或者專利權的，當事人應當訂立書麵合同，並向國務院專利行政部門登記，由國務院專利行政部門予以公告。
Where the right to apply for a patent or the patent right is assigned, the parties shall conclude a written contract and register it with the patent administration department under the State Council. The patent administration department under the State Council shall announce the registration.
專利申請權或者專利權的轉讓自登記之日起生效。
The assignment shall take effect as of the date of registration.
第十一條 發(fa)明(ming)和(he)實(shi)用(yong)新(xin)型(xing)專(zhuan)利(li)權(quan)被(bei)授(shou)予(yu)後(hou)，除(chu)本(ben)法(fa)另(ling)有(you)規(gui)定(ding)的(de)以(yi)外(wai)，任(ren)何(he)單(dan)位(wei)或(huo)者(zhe)個(ge)人(ren)未(wei)經(jing)專(zhuan)利(li)權(quan)人(ren)許(xu)可(ke)，都(dou)不(bu)得(de)實(shi)施(shi)其(qi)專(zhuan)利(li)，即(ji)不(bu)得(de)為(wei)生(sheng)產(chan)經(jing)營(ying)目(mu)的(de)製(zhi)造(zao)、使用、許諾銷售、銷售、進口其專利產品，或者使用其專利方法以及使用、許諾銷售、銷售、進口依照該專利方法直接獲得的產品。
Article 11 After the grant of the patent right for an invention or utility model, except where otherwise provided for in this Law, no entity or individual may, without the authorization of the patentee, exploit the patent, that is, make, use, offer to sell, sell or import the patented product, or use the patented process, and use, offer to sell, sell or import the product directly obtained by the patented process, for production or business purposes.
外觀設計專利權被授予後，任何單位或者個人未經專利權人許可，都不得實施其專利，即不得為生產經營目的製造、銷售、進口其外觀設計專利產品。
After the grant of the patent right for a design, no entity or individual may, without the authorization of the patentee, exploit the patent, that is, make, sell or import the product incorporating its or his patented design, for production or business purposes.
第十二條 任何單位或者個人實施他人專利的，應當與專利權人訂立書麵實施許可合同，向專利權人支付專利使用費。
Article 12. Any entity or individua1 exploiting the patent of another shall conclude with the patentee a written license contract for exploitation and pay the patentee a fee for the exploitation of the patent.
被許可人無權允許合同規定以外的任何單位或者個人實施該專利。
The licensee has no right to authorize any entity or individual, other than that referred to in the contract for exploitation, to exploit the patent.
第十三條 發明專利申請公布後，申請人可以要求實施其發明的單位或者個人支付適當的費用。
Article 13. After the publication of the application for a patent for invention, the applicant may require the entity or individual exploiting the invention to pay an appropriate fee.
第十四條 國有企業事業單位的發明專利，對國家利益或者公共利益具有重大意義的，國務院有關主管部門和省、自治區、直轄市人民政府報經國務院批準，可以決定在批準的範圍內推廣應用，允許指定的單位實施，
Article 14. Where any patent for invention, belonging to any State-owned enterprise or institution, is of great significance to the interest of the State or to the public interest, the competent departments concerned under the State council and the people's governments of provinces, autonomous regions or municipalities directly under the Central Government may, after approval by the State Council, decide that the patented invention be spread and applied within the approved limits, and allow designated entities to exploit that invention.
由實施單位按照國家規定向專利權人支付使用費。
The exploiting entity shall, according to the regulations of the State, pay a fee for exploitation to the patentee .
中國集體所有製單位和個人的發明專利，對國家利益或者公共利益具有重大意義，需要推廣應用的，參照前款規定辦理。
Any patent for invention belonging to a Chinese individual or an entity under collective ownership, which is of great significance to the interest of the State or to the public interest and is in need of spreading and application, may be treated alike by making reference to the provisions of the preceding paragraph.
第十五條 專利權人有權在其專利產品或者該產品的包裝上標明專利標記和專利號。
Article l5. The patentee has the right to affix a patent marking and to indicate the number of the patent on the patented product or on the packing of that product.
第十六條 被授予專利權的單位應當對職務發明創造的發明人或者設計人給予獎勵；發明創造專利實施後，根據其推廣應用的範圍和取得的經濟效益，對發明人或者設計人給予合理的報酬。
Article 16. The entity that is granted a patent right shall award to the inventor or creator of a service invention-creation a reward and, upon exploitation of the patented invention-creation, shall pay the inventor or creator a reasonable remuneration based on the extent of spreading and application and the economic benefits yielded.
第十七條 發明人或者設計人有在專利文件中寫明自己是發明人或者設計人的權利。
Article l7. The inventor or creator has the right to be named as such in the patent document.
第十八條 在中國沒有經常居所或者營業所的外國人、外(wai)國(guo)企(qi)業(ye)或(huo)者(zhe)外(wai)國(guo)其(qi)他(ta)組(zu)織(zhi)在(zai)中(zhong)國(guo)申(shen)請(qing)專(zhuan)利(li)的(de)，依(yi)照(zhao)其(qi)所(suo)屬(shu)國(guo)同(tong)中(zhong)國(guo)簽(qian)訂(ding)的(de)協(xie)議(yi)或(huo)者(zhe)共(gong)同(tong)參(can)加(jia)的(de)國(guo)際(ji)條(tiao)約(yue)，或(huo)者(zhe)依(yi)照(zhao)互(hu)惠(hui)原(yuan)則(ze)，根(gen)據(ju)本(ben)法(fa)辦(ban)理(li)。
Article 18. Where any foreigner, foreign enterprise or other foreign organization having no habitual residence or business office in China files an application for a patent in China, the application sha1l be treated under this Law in accordance with any agreement concluded between the country to which the applicant belongs and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of reciprocity.
第十九條 在中國沒有經常居所或者營業所的外國人、外國企業或者外國其他組織在中國申請專利和辦理其他專利事務的，應當委托國務院專利行政部門指定的專利代理機構辦理。
Article l9. Where any foreigner, foreign enterprise or other foreign organization having no habitual residence or business office in China applies for a patent, or has other patent matters to attend to, in China, it or he shall appoint a patent agency designated by the patent administration department under the State Council to act as his or its agent.
中國單位或者個人在國內申請專利和辦理其他專利事務的，可以委托專利代理機構辦理。
Where any Chinese entity or individual applies for a patent or has other patent matters to attend to in the country, it or he may appoint a patent agency to act as its or his agent.
代理機構應當遵守法律、行政法規，按照被代理人的委托辦理專利申請或者其他專利事務；
The patent agency shall comply with the provisions of laws and administrative regulations, and handle patent applications and other patent matters according to the instructions of its clients.
對被代理人發明創造的內容，除專利申請已經公布或者公告的以外，負有保密責任。
In respect of the contents of its clients' inventions-creations, except for those that have been published or announced, the agency shall bear the responsibility of keeping them confidential.
專利專利代理機構的具體管理辦法由國務院規定。
The administrative regulations governing the patent agency shall be formulated by the State Council.
第二十條 中zhong國guo單dan位wei或huo者zhe個ge人ren將jiang其qi在zai國guo內nei完wan成cheng的de發fa明ming創chuang造zao向xiang外wai國guo申shen請qing專zhuan利li的de，應ying當dang先xian向xiang國guo務wu院yuan專zhuan利li行xing政zheng部bu門men申shen請qing專zhuan利li，委wei托tuo其qi指zhi定ding的de專zhuan利li代dai理li機ji構gou辦ban理li，並bing遵zun守shou本ben法fa第di四si條tiao的de規gui定ding。
Article 20. Where any Chinese entity or individual intends to file an application in a foreign country for a patent for invention-creation made in China, it or he shall file first an application for patent with the patent administration department under the State Council, appoint a patent agency designated by the said department to act as its or his agent, and comply with the provisions of Article 4 of this Law.
中國單位或者個人可以根據中華人民共和國參加的有關國際條約提出專利國際申請。
Any Chinese entity or individual may file an international application for patent in accordance with any international treaty concerned to which China is party.
申請人提出專利國際申請的，應當遵守前款規定。
The applicant filing an international application for patent shall comply with the provisions of the preceding paragraph.
國務院專利行政部門依照中華人民共和國參加的有關國際條約、本法和國務院有關規定處理專利國際申請。
The patent administration department under the State Council shall handle any international application for patent in accordance with the international treaty concerned to which China is party, this Law and the relevant regulations of the State Council.
第二十一條 國務院專利行政部門及其專利複審委員會應當按照客觀、公正、準確、及時的要求，依法處理有關專利的申請和請求。
Article 21. The patent administration department under the State Council and its Patent Reexamination Board shall handle any patent application and patent-related request according to law and in conformity with the requirements for being objective, fair, correct and timely.
在專利申請公布或者公告前，國務院專利行政部門的工作人員及有關人員對其內容負有保密責任。
Until the publication or announcement of the application for a patent, staff members of the patent administration department under the State Council and other persons involved have the duty to keep its contents secret.
第二章 授予專利權的條件
Chapter II Requirements for Grant of Patent Right
第二十二條 授予專利權的發明和實用新型，應當具備新穎性、創造性和實用性。
Article 22. Any invention or utility model for which patent right may be granted must possess novelty, inventiveness and practical app1icability.
新穎性，是指在申請日以前沒有同樣的發明或者實用新型在國內外出版物上公開發表過、在(zai)國(guo)內(nei)公(gong)開(kai)使(shi)用(yong)過(guo)或(huo)者(zhe)以(yi)其(qi)他(ta)方(fang)式(shi)為(wei)公(gong)眾(zhong)所(suo)知(zhi)，也(ye)沒(mei)有(you)同(tong)樣(yang)的(de)發(fa)明(ming)或(huo)者(zhe)實(shi)用(yong)新(xin)型(xing)由(you)他(ta)人(ren)向(xiang)國(guo)務(wu)院(yuan)專(zhuan)利(li)行(xing)政(zheng)部(bu)門(men)提(ti)出(chu)過(guo)申(shen)請(qing)並(bing)且(qie)記(ji)載(zai)在(zai)申(shen)請(qing)日(ri)以(yi)後(hou)公(gong)布(bu)的(de)專(zhuan)利(li)申(shen)請(qing)文(wen)件(jian)中(zhong)。
Novelty means that, before the date of filing, no identical invention or utility model has been publicly disclosed in publications in the country or abroad or has been publicly used or made known to the public by any other means in the country, nor has any other person filed previously with the Patent Administration Department Under the State Council an application which described the identical invention or utility mode1 and was published after the said date of filing.
創造性，是指同申請日以前已有的技術相比，該發明有突出的實質性特點和顯著的進步，該實用新型有實質性特點和進步。
Inventiveness means that, as compared with the technology existing before the date of filing, the invention has prominent substantive features and represents a notable progress and that the utility model has substantive features and represents progress.
實用性，是指該發明或者實用新型能夠製造或者使用，並且能夠產生積極效果。
Practical applicability means that the invention or utility model can be made or used and can produce effective results.
第二十三條 shouyuzhuanliquandewaiguansheji，yingdangtongshenqingriyiqianzaiguoneiwaichubanwushanggongkaifabiaoguohuozheguoneigongkaishiyongguodewaiguanshejibuxiangtonghebuxiangjinsi，bingbudeyutarenzaixianqudedehefaquanlixiangchongtu。
Article 23. Any design for which patent right may be granted must not be identical with and simi1ar to any design which, before the date of filing, has been publicly disclosed in publications in the country or abroad or has been publicly used in the country, and must not be in conflict with any prior right of any other person.
第二十四條 申請專利的發明創造在申請日以前六個月內，有下列情形之一的，不喪失新穎性：
Article 24. An invention-creation for which a patent is applied for does not lose its novelty where, within six months before the date of filing, one of the following events occurred:
（一）在中國政府主辦或者承認的國際展覽會上首次展出的；
(l) where it was first exhibited at an international exhibition sponsored or recognized by the Chinese Government;
（二）在規定的學術會議或者技術會議上首次發表的；
(2) where it was first made public at a prescribed academic or technological meeting;
（三）他人未經申請人同意而泄露其內容的。
(3) where it was disc1osed by any person without the consent of the applicant.
第二十五條 對下列各項，不授予專利權：
Article 25 For any of the following, no patent right shall be granted:
（一）科學發現；
(1) scientific discoveries;
（二）智力活動的規則和方法；
(2) rules and methods for mental activities;
（三）疾病的診斷和治療方法；
(3) methods for the diagnosis or for the treatment of diseases;
（四）動物和植物品種；
(4) animal and plant varieties;
（五）用原子核變換方法獲得的物質。
(5) substances obtained by means of nuclear transformation.
對前款第（四）項所列產品的生產方法，可以依照本法規定授予專利權。
For processes used in producing products referred to in items (4) of the preceding paragraph, patent right may be granted in accordance with the provisions of this Law.
第三章 專利的申請
Chapter III Application for Patent
第二十六條 申請發明或者實用新型專利的，應當提交請求書、說明書及其摘要和權利要求書等文件。
Article 26. Where an application for a patent for invention or utility model is filed, a request, a description and its abstract, and claims shall be submitted.
請求書應當寫明發明或者實用新型的名稱，發明人或者設計人的姓名，申請人姓名或者名稱、地址，以及其他事項。
The request shall state the title of the invention or utility model, the name of the inventor or creator, the name and the address of the applicant and other related matters.
說明書應當對發明或者實用新型作出清楚、完整的說明，以所屬技術領域的技術人員能夠實現為準；必要的時候，應當有附圖。
The description shall set forth the invention or utility model in a manner sufficiently clear and complete so as to enable a person skilled in the re1evant field of techno1ogy to carry it out; where necessary, drawings are required.
摘要應當簡要說明發明或者實用新型的技術要點。
The abstract shall state briefly the main technical points of the invention or utility model.
權利要求書應當以說明書為依據，說明要求專利保護的範圍
The claims sha1l be supported by the description and shal1 state the extent of the patent protection asked for.
第二十七條 申請外觀設計專利的，應當提交請求書以及該外觀設計的圖片或者照片等文件，並且應當寫明使用該外觀設計的產品及其所屬的類別。
Article 27. Where an app1ication for a patent for design is filed, a request, drawings or photographs of the design shall be submitted, and the product incorporating the design and the class to which that product be1ongs shall be indicated.
第二十八條 國務院專利行政部門收到專利申請文件之日為申請日。
Article 28. The date on which the Patent Administration Department Under the State Council receives the application shall be the date of filing.
如果申請文件是郵寄的，以寄出的郵戳日為申請日。
If the app1ication is sent by mail, the date of mailing indicated by the postmark shall be the date of filing.
第二十九條 申(shen)請(qing)人(ren)自(zi)發(fa)明(ming)或(huo)者(zhe)實(shi)用(yong)新(xin)型(xing)在(zai)外(wai)國(guo)第(di)一(yi)次(ci)提(ti)出(chu)專(zhuan)利(li)申(shen)請(qing)之(zhi)日(ri)起(qi)十(shi)二(er)個(ge)月(yue)內(nei)，或(huo)者(zhe)自(zi)外(wai)觀(guan)設(she)計(ji)在(zai)外(wai)國(guo)第(di)一(yi)次(ci)提(ti)出(chu)專(zhuan)利(li)申(shen)請(qing)之(zhi)日(ri)起(qi)六(liu)個(ge)月(yue)內(nei)，又(you)在(zai)中(zhong)國(guo)就(jiu)相(xiang)同(tong)主(zhu)題(ti)提(ti)出(chu)專(zhuan)利(li)申(shen)請(qing)的(de)，依(yi)照(zhao)該(gai)外(wai)國(guo)同(tong)中(zhong)國(guo)簽(qian)訂(ding)的(de)協(xie)議(yi)或(huo)者(zhe)共(gong)同(tong)參(can)加(jia)的(de)國(guo)際(ji)條(tiao)約(yue)，或(huo)者(zhe)依(yi)照(zhao)相(xiang)互(hu)承(cheng)認(ren)優(you)先(xian)權(quan)的(de)原(yuan)則(ze)，可(ke)以(yi)享(xiang)有(you)優(you)先(xian)權(quan)。
Article 29. Where , within twelve months from the date on which any applicant first filed in a foreign country an application for a Patent for invention or utility model, or within six months from the date on which any applicant first filed in a foreign country an application for a patent for design, he or it files in China an application for a patent for the same subject matter, he or it may, in accordance with any agreement concluded between the said foreign country and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of mutual recognition of the right of priority, enjoy a right of priority.

Where, within twelve months from the date on which any applicant first filed in China an application for a patent for invention or utility model, he or it files with the Patent Administration Department Under the State Council an application for a patent for the same subject matter , he or it may enjoy a right of priority.
第三十條 申請人要求優先權的，應當在申請的時候提出書麵聲明，並且在三個月內提交第一次提出的專利申請文件的副本；未提出書麵聲明或者逾期未提交專利申請文件副本的，視為未要求優先權。
Article 30. Any applicant who claims the right of priority shall make a written declaration when the application is filed, and submit, within three months, a copy of the patent application document which was first filed; if the applicant fails to make the written declaration or to meet the time limit for submitting the patent application document, the claim to the right of priority shall be deemed not to have been made.
第三十一條 一件發明或者實用新型專利申請應當限於一項發明或者實用新型。
Article 3l. An application for a patent for invention or utility model shall be limited to one invention or uti1ity model.
屬於一個總的發明構思的兩項以上的發明或者實用新型，可以作為一件申請提出。
Two or more inventions or utility models belonging to a single general inventive concept may be filed as one application.
一件外觀設計專利申請應當限於一種產品所使用的一項外觀設計。
An application for a patent for design shall be limited to one design incorporated in one product.
用於同一類別並且成套出售或者使用的產品的兩項以上的外觀設計，可以作為一件申請提出。
Two or more designs which are incorporated in products belonging to the same c1ass and are sold or used in sets may be filed as one application.
第三十二條 申請人可以在被授予專利權之前隨時撤回其專利申請。
Article 32. An applicant may withdraw his or its application for a patent at any time before the patent right is granted.
第三十三條 申shen請qing人ren可ke以yi對dui其qi專zhuan利li申shen請qing文wen件jian進jin行xing修xiu改gai，但dan是shi，對dui發fa明ming和he實shi用yong新xin型xing專zhuan利li申shen請qing文wen件jian的de修xiu改gai不bu得de超chao出chu原yuan說shuo明ming書shu和he權quan利li要yao求qiu書shu記ji載zai的de範fan圍wei，對dui外wai觀guan設she計ji專zhuan利li申shen請qing文wen件jian的de修xiu改gai不bu得de超chao出chu原yuan圖tu片pian或huo者zhe照zhao片pian表biao示shi的de範fan圍wei。
Article 33. An applicant may amend his or its application for a patent, but the amendment to the application for a patent for invention or utility model may not go beyond the scope of the disclosure contained in the initial description and claims, and the amendment to the application for a patent for design may not go beyond the scope of the disclosure as shown in the initial drawings or photographs.
第四章 專利申請的審查和批準
Chapter IV Examination and Approval of Application for Patent
第三十四條 國務院專利行政部門收到發明專利申請後，經初步審查認為符合本法要求的，自申請日起滿十八個月，即行公布。
Article 34. Where, after receiving an application for a patent for invention, the Patent Administration Department Under the State Council, upon preliminary examination, finds the application to be in conformity with the requirements of this Law, it shall publish the application promptly after the expiration of eighteen months from the date of filing.
國務院專利行政部門可以根據申請人的請求早日公布其申請。
Upon the request of the applicant, the Patent Administration Department Under the State Council publishes the application earlier.
第三十五條 發明專利申請自申請日起三年內，國務院專利行政部門可以根據申請人隨時提出的請求，對其申請進行實質審查；
Article 35. Upon the request of the applicant for a patent for invention, made at any time within three years from the date of filing, the Patent Administration Department Under the State Council will proceed to examine the application as to its substance.
申請人無正當理由逾期不請求實質審查的，該申請即被視為撤回。
If, without any justified reason, the applicant fails to meet the time limit for requesting examination as to substance, the application shall be deemed to have been withdrawn.
國務院專利行政部門認為必要的時候，可以自行對發明專利申請進行實質審查。
The Patent Administration Department Under the State Council may, on its own initiative, proceed to examine any application for a patent for invention as to its substance when it deems it necessary.
第三十六條 發明專利的申請人請求實質審查的時候，應當提交在申請日前與其發明有關的參考資料。
Article 36. When the applicant for a patent for invention requests examination as to substance , he or lit shall furnish pre-filing date reference materials concerning the invention.
發fa明ming專zhuan利li已yi經jing在zai外wai國guo提ti出chu過guo申shen請qing的de，國guo務wu院yuan專zhuan利li行xing政zheng部bu門men可ke以yi要yao求qiu申shen請qing人ren在zai指zhi定ding期qi限xian內nei提ti交jiao該gai國guo為wei審shen查zha其qi申shen請qing進jin行xing檢jian索suo的de資zi料liao或huo者zhe審shen查zha結jie果guo的de資zi料liao；
For an application for a patent for invention that has been already filed in a foreign country, the patent administration department under the State Council may ask the app1icant to furnish within a specified time limit documents concerning any search made for the purpose of examining that application, or concerning the results of any examination made, in that country.
無正當理由逾期不提交的，該申請即被視為撤回。
If, at the expiration of the specified time limit, without any justified reason, the said documents are not furnished, the application shall be deemed to have been withdrawn.
第三十七條 國(guo)務(wu)院(yuan)專(zhuan)利(li)行(xing)政(zheng)部(bu)門(men)對(dui)發(fa)明(ming)專(zhuan)利(li)申(shen)請(qing)進(jin)行(xing)實(shi)質(zhi)審(shen)查(zha)後(hou)，認(ren)為(wei)不(bu)符(fu)合(he)本(ben)法(fa)規(gui)定(ding)的(de)，應(ying)當(dang)通(tong)知(zhi)申(shen)請(qing)人(ren)，要(yao)求(qiu)其(qi)在(zai)指(zhi)定(ding)的(de)期(qi)限(xian)內(nei)陳(chen)述(shu)意(yi)見(jian)，或(huo)者(zhe)對(dui)其(qi)申(shen)請(qing)進(jin)行(xing)修(xiu)改(gai)；
Article 37. Where the Patent Administration Department Under the State Council, after it has made the examination as to substance of the application for a patent for invention, finds that the application is not in conformity with the provisions of this Law, it shall notify the applicant and request him or it to submit, within a specified time limit, his or its observations or to amend the application.
無正當理由逾期不答複的，該申請即被視為撤回。
If, without any justified reason, the time limit for making response is not met, the application shall be deemed to have been withdrawn.
第三十八條 發明專利申請經申請人陳述意見或者進行修改後，國務院專利行政部門仍然認為不符合本法規定的，應當予以駁回。
Article 38. Where, after the applicant has made the observations or amendments, the Patent Administration Department Under the State Council finds that the application for a patent for invention is still not in conformity with the provisions of this Law, the application shall be rejected.
第三十九條 發fa明ming專zhuan利li申shen請qing經jing實shi質zhi審shen查zha沒mei有you發fa現xian駁bo回hui理li由you的de，由you國guo務wu院yuan專zhuan利li行xing政zheng部bu門men作zuo出chu授shou予yu發fa明ming專zhuan利li權quan的de決jue定ding，發fa給gei發fa明ming專zhuan利li證zheng書shu，同tong時shi予yu以yi登deng記ji和he公gong告gao。
Article 39. Where it is found after examination as to substance that there is no cause for rejection of the application for a patent for invention, the patent administration department under the State Council shall make a decision to grant the patent right for invention, issue the certificate of patent for invention, and register and announce it.
發明專利權自公告之日起生效。
The patent right for invention shall take effect as of the date of the announcement.
第四十條 實(shi)用(yong)新(xin)型(xing)和(he)外(wai)觀(guan)設(she)計(ji)專(zhuan)利(li)申(shen)請(qing)經(jing)初(chu)步(bu)審(shen)查(zha)沒(mei)有(you)發(fa)現(xian)駁(bo)回(hui)理(li)由(you)的(de)，由(you)國(guo)務(wu)院(yuan)專(zhuan)利(li)行(xing)政(zheng)部(bu)門(men)作(zuo)出(chu)授(shou)予(yu)實(shi)用(yong)新(xin)型(xing)專(zhuan)利(li)權(quan)或(huo)者(zhe)外(wai)觀(guan)設(she)計(ji)專(zhuan)利(li)權(quan)的(de)決(jue)定(ding)，發(fa)給(gei)相(xiang)應(ying)的(de)專(zhuan)利(li)證(zheng)書(shu)，同(tong)時(shi)予(yu)以(yi)登(deng)記(ji)和(he)公(gong)告(gao)。
Article 40. Where it is found after preliminary examination that there is no cause for rejection of the application for a patent for utility model or design, the patent administration department under the State Council shall make a decision to grant the patent right for utility model or the patent right for design, issue the relevant patent certificate, and register and announce it.
實用新型專利權和外觀設計專利權自公告之日起生效。
The patent right for utility model or design shall take effect as of the date of the announcement.
第四十一條 國務院專利行政部門設立專利複審委員會。
Article 41. The patent administration department under the State Council shall set up a Patent Reexamination Board.
專利申請人對國務院專利行政部門駁回申請的決定不服的，可以自收到通知之日起三個月內，向專利複審委員會請求複審。
Where an applicant for patent is not satisfied with the decision of the said department rejecting the application, the applicant may, within three months from the date of receipt of the notification, request the Patent Reexamination Board to make a reexamination.
專利複審委員會複審後，作出決定，並通知專利申請人。
The Patent Reexamination Board shall, after reexamination, make a decision and notify the applicant for patent.
專利申請人對專利複審委員會的複審決定不服的，可以自收到通知之日起三個月內向人民法院起訴。
Where the applicant for patent is not satisfied with the decision of the Patent Reexamination Board, it or he may, within three months from the date of receipt of the notification, institute legal proceedings in the people's court.
第五章 專利權的期限、終止和無效
Chapter V Duration, Cessation and Invalidation of Patent Right
第四十二條 發明專利權的期限為二十年，實用新型專利權和外觀設計專利權的期限為十年，均自申請日起計算。
Article 42. The duration of patent right for inventions shall be twenty years, the duration of patent right for utility models and patent right for designs shall be ten years, counted from the date of filing.
第四十三條 專利權人應當自被授予專利權的當年開始繳納年費。
Article 43. The patentee shall pay an annual fee beginning with the year in which the patent right was granted.
第四十四條 有下列情形之一的，專利權在期限屆滿前終止：
Article 44. In any of the following cases, the patent right shall cease before the expiration of its duration:
（一）沒有按照規定繳納年費的；
(1) where an annual fee is not paid as prescribed;
（二）專利權人以書麵聲明放棄其專利權的。
(2) where the patentee abandons his or its patent right by a written declaration.
專利權在期限屆滿前終止的，由國務院專利行政部門登記和公告。
Any cessation of the patent right shall be registered and announced by the Patent Administration Department Under the State Council .
第四十五條 ziguowuyuanzhuanlixingzhengbumengonggaoshouyuzhuanliquanzhiriqi，renhedanweihuozhegerenrenweigaizhuanliquandeshouyubufuhebenfayouguanguidingde，keyiqingqiuzhuanlifushenweiyuanhuixuangaogaizhuanliquanwuxiao。
Article 45. Where, starting from the date of the announcement of the grant of the patent right by the patent administration department under the State Council, any entity or individual considers that the grant of the said patent right is not in conformity with the relevant provisions of this Law, it or he may request the Patent Reexamination Board to declare the patent right invalid.
第四十六條 專利複審委員會對宣告專利權無效的請求應當及時審查和作出決定，並通知請求人和專利權人。
Article 46. The Patent Reexamination Board shall examine the request for invalidation of the patent right promptly, make a decision on it and notify the person who made the request and the patentee.
宣告專利權無效的決定，由國務院專利行政部門登記和公告。
The decision declaring the patent right invalid shall be registered and announced by the patent administration department under the State Council.
對專利複審委員會宣告專利權無效或者維持專利權的決定不服的，可以自收到通知之日起三個月內向人民法院起訴。
Where the patentee or the person who made the request for invalidation is not satisfied with the decision of the Patent Reexamination Board declaring the patent right invalid or upholding the patent right, such party may, within three months from receipt of the notification of the decision, institute legal proceedings in the people's court.
人民法院應當通知無效宣告請求程序的對方當事人作為第三人參加訴訟。
The people's court shall notify the person that is the opponent party of that party in the invalidation procedure to appear as a third party in the legal proceedings.
第四十七條 宣告無效的專利權視為自始即不存在。
Article 47. Any patent right which has been declared invalid shall be deemed to be non-existent from the beginning.
宣告專利權無效的決定，對在宣告專利權無效前人民法院作出並已執行的專利侵權的判決、裁(cai)定(ding)，已(yi)經(jing)履(lv)行(xing)或(huo)者(zhe)強(qiang)製(zhi)執(zhi)行(xing)的(de)專(zhuan)利(li)侵(qin)權(quan)糾(jiu)紛(fen)處(chu)理(li)決(jue)定(ding)，以(yi)及(ji)已(yi)經(jing)履(lv)行(xing)的(de)專(zhuan)利(li)實(shi)施(shi)許(xu)可(ke)合(he)同(tong)和(he)專(zhuan)利(li)權(quan)轉(zhuan)讓(rang)合(he)同(tong)，不(bu)具(ju)有(you)追(zhui)溯(su)力(li)。但(dan)是(shi)因(yin)專(zhuan)利(li)權(quan)人(ren)的(de)惡(e)意(yi)給(gei)他(ta)人(ren)造(zao)成(cheng)的(de)損(sun)失(shi)，應(ying)當(dang)給(gei)予(yu)賠(pei)償(chang)。
The decision declaring the patent right invalid shall have no retroactive effect on any judgement or ruling of patent infringement which has been pronounced and enforced by the people's court, on any decision concerning the handling of a dispute over patent infringement which has been complied with or compulsorily executed, or on any contract of patent license or of assignment of patent right which has been performed prior to the declaration of the patent right invalid; however, the damage caused to other persons in bad faith on the part of the patentee shall be compensated.
如(ru)果(guo)依(yi)照(zhao)前(qian)款(kuan)規(gui)定(ding)，專(zhuan)利(li)權(quan)人(ren)或(huo)者(zhe)專(zhuan)利(li)權(quan)轉(zhuan)讓(rang)人(ren)不(bu)向(xiang)被(bei)許(xu)可(ke)實(shi)施(shi)專(zhuan)利(li)人(ren)或(huo)者(zhe)專(zhuan)利(li)權(quan)受(shou)讓(rang)人(ren)返(fan)還(hai)專(zhuan)利(li)使(shi)用(yong)費(fei)或(huo)者(zhe)專(zhuan)利(li)權(quan)轉(zhuan)讓(rang)費(fei)，明(ming)顯(xian)違(wei)反(fan)公(gong)平(ping)原(yuan)則(ze)，專(zhuan)利(li)權(quan)人(ren)或(huo)者(zhe)專(zhuan)利(li)權(quan)轉(zhuan)讓(rang)人(ren)應(ying)當(dang)向(xiang)被(bei)許(xu)可(ke)實(shi)施(shi)專(zhuan)利(li)人(ren)或(huo)者(zhe)專(zhuan)利(li)權(quan)受(shou)讓(rang)人(ren)返(fan)還(hai)全(quan)部(bu)或(huo)者(zhe)部(bu)分(fen)專(zhuan)利(li)使(shi)用(yong)費(fei)或(huo)者(zhe)專(zhuan)利(li)權(quan)轉(zhuan)讓(rang)費(fei)。
If, pursuant to the provisions of the preceding paragraph, the patentee or the assignor of the patent right makes no repayment to the licensee or the assignee of the patent right of the fee for the exploitation of the patent or of the price for the assignment of the patent right, which is obviously contrary to the principle of equity, the patentee or the assignor of the patent right shall repay the whole or part of the fee for the exploitation of the patent or of the price for the assignment of the patent right to the licensee or the assignee of the patent right.
第六章 專利實施的強製許可
Chapter VI Compulsory License for Exploitation of Patent
第四十八條 jubeishishitiaojiandedanweiyihelidetiaojianqingqiufaminghuozheshiyongxinxingzhuanliquanrenxukeshishiqizhuanli，erweinengzaihelichangdeshijianneihuodezhezhongxukeshi，guowuyuanzhuanlixingzhengbumengenjugaidanweideshenqing，keyigeiyushishigaifamingzhuanlihuozheshiyongxinxingzhuanlideqiangzhixuke。
Article 48. Where any entity which is qualified to exploit the invention or utility model has made requests for authorization from the patentee of an invention or utility model to exploit its or his patent on reasonable terms and conditions and such efforts have not been successful within a reasonable period of time, the Patent Administration Department Under the State Council may, upon the request of that entity, grant a compulsory license to exploit the patent for invention or utility model.
第四十九條 在zai國guo家jia出chu現xian緊jin急ji狀zhuang態tai或huo者zhe非fei常chang情qing況kuang時shi，或huo者zhe為wei了le公gong共gong利li益yi的de目mu的de，國guo務wu院yuan專zhuan利li行xing政zheng部bu門men可ke以yi給gei予yu實shi施shi發fa明ming專zhuan利li或huo者zhe實shi用yong新xin型xing專zhuan利li的de強qiang製zhi許xu可ke。
Article 49. Where a national emergency or any extraordinary state of affairs occurs, or where the public interest so requires, the Patent Administration Department Under the State Council may grant a compulsory license to exploit the patent for invention or utility model.
第五十條 yixiangqudezhuanliquandefaminghuozheshiyongxinxingbiqianyijingqudezhuanliquandefaminghuozheshiyongxinxingjuyouxianzhujingjiyiyidezhongdajishujinbu，qishishiyouyoulaiyuqianyifaminghuozheshiyongxinxingdeshishide，guowuyuanzhuanlixingzhengbumengenjuhouyizhuanliquanrendeshenqing，keyigeiyushishiqianyifaminghuozheshiyongxinxingdeqiangzhixuke。
Article 50. Where the invention or utility model for which the patent right has been granted involves important technical advance of considerable economic significance in relation to another invention or utility model for which a patent right has been granted earlier and the exploitation of the later invention or utility model depends on the exploitation of the earlier invention or utility model, the patent administration department under the State Council may, upon the request of the later patentee, grant a compulsory license to exploit the earlier invention or utility model.
在(zai)依(yi)照(zhao)前(qian)款(kuan)規(gui)定(ding)給(gei)予(yu)實(shi)施(shi)強(qiang)製(zhi)許(xu)可(ke)的(de)情(qing)形(xing)下(xia)，國(guo)務(wu)院(yuan)專(zhuan)利(li)行(xing)政(zheng)部(bu)門(men)根(gen)據(ju)前(qian)一(yi)專(zhuan)利(li)權(quan)人(ren)的(de)申(shen)請(qing)，也(ye)可(ke)以(yi)給(gei)予(yu)實(shi)施(shi)後(hou)一(yi)發(fa)明(ming)或(huo)者(zhe)實(shi)用(yong)新(xin)型(xing)的(de)強(qiang)製(zhi)許(xu)可(ke)。
Where, according to the preceding paragraph, a compulsory license is granted, the Patent Administration Department Under the State Council may, upon the request of the earlier patentee, also grant a compulsory license to exploit the later invention or utility model.
第五十一條 依照本法規定申請實施強製許可的單位或者個人，應當提出未能以合理條件與專利權人簽訂實施許可合同的證明。
Article 51. The entity or individual requesting, in accordance with the provisions of this Law, a compulsory license for exploitation shall furnish proof that it or he has not been able to conclude with the patentee a license contract for exploitation on reasonable terms and conditions.
第五十二條 國務院專利行政部門作出的給予實施強製許可的決定，應當及時通知專利權人，並予以登記和公告。
Article 52. The decision made by the patent administration department under the State Council granting a compulsory license for exploitation shall be notified promptly to the patentee concerned, and shall be registered and announced.
給予實施強製許可的決定，應當根據強製許可的理由規定實施的範圍和時間。
In the decision granting the compulsory license for exploitation, the scope and duration of the exploitation shall be specified on the basis of the reasons justifying the grant.
強製許可的理由消除並不再發生時，國務院專利行政部門應當根據專利權人的請求，經審查後作出終止實施強製許可的決定。
If and when the circumstances which led to such compulsory license cease to exist and are unlikely to recur, the patent administration department under the State Council may, after review upon the request of the patentee, terminate the compulsory license.
第五十三條 取得實施強製許可的單位或者個人不享有獨占的實施權，並且無權允許他人實施。
Article 53. Any entity or individual that is granted a compulsory license for exploitation shall not have an exclusive right to exploit and shall not have the right to authorize exploitation by any others.
第五十四條 取得實施強製許可的單位或者個人應當付給專利權人合理的使用費，其數額由雙方協商；
Article 54. The entity or individual that is granted a compulsory license for exploitation shall pay to the patentee a reasonable exploitation fee, the amount of which shall be fixed by both parties in consultations.
雙方不能達成協議的，由國務院專利行政部門裁決。
Where the parties fail to reach an agreement, the Patent Administration Department Under the State Council shall adjudicate.
第五十五條 zhuanliquanrenduiguowuyuanzhuanlixingzhengbumenguanyushishiqiangzhixukedejuedingbufude，zhuanliquanrenhequdeshishiqiangzhixukededanweihuozhegerenduiguowuyuanzhuanlixingzhengbumenguanyushishiqiangzhixukedeshiyongfeidecaijuebufude，keyizishoudaotongzhizhiriqisangeyueneixiangrenminfayuanqisu。
Article 55. Where the patentee is not satisfied with the decision of the patent administration department under the State Council granting a compulsory license for exploitation, or where the patentee or the entity or individual that is granted the compulsory license for exploitation is not satisfied with the ruling made by the patent administration department under the State Council regarding the fee payable for exploitation, it or he may, within three months from the receipt of the date of notification, institute legal proceedings in the people's court.
第七章 專利權的保護
Chapter VII Protection of Patent Right
第五十六條 發明或者實用新型專利權的保護範圍以其權利要求的內容為準，
Article 56. The extent of protection of the patent right for invention or utility model shall be determined by the terms of the claims.
說明書及附圖可以用於解釋權利要求。
The description and the appended drawings may be used to interpret the claims.
外觀設計專利權的保護範圍以表示在圖片或者照片中的該外觀設計專利產品為準。
The extent of protection of the patent right for design shall be determined by the product incorporating the patented design as shown in the drawings or photographs.
第五十七條 未經專利權人許可，實施其專利，即侵犯其專利權，引起糾紛的，由當事人協商解決；
Article 57. Where a dispute arises as a result of the exploitation of a patent without the authorization of the patentee, that is, the infringement of the patent right of the patentee, it shall be settled through consultation by the parties.
不願協商或者協商不成的，專利權人或者利害關係人可以向人民法院起訴，也可以請求管理專利工作的部門處理。
Where the parties are not willing to consult with each other or where the consultation fails, the patentee or any interested party may institute legal proceedings in the people's court, or request the administrative authority for patent affairs to handle the matter.
管理專利工作的部門處理時，認定侵權行為成立的，可以責令侵權人立即停止侵權行為，
When the administrative authority for patent affairs handling the matter considers that the infringement is established, it may order the infringer to stop the infringing act immediately.
當事人不服的，可以自收到處理通知之日起十五日內依照《中華人民共和國行政訴訟法》向人民法院起訴；
If the infringer is not satisfied with the order, he may, within 15 days from the date of receipt of the notification of the order, institutes legal proceedings in the people's court in accordance with the Administrative Procedure Law of the People's Republic of China.
侵權人期滿不起訴又不停止侵權行為的，管理專利工作的部門可以申請人民法院強製執行。 The said authority handling the matter may, upon the request of the parties, mediate in the amount of compensation for the damage caused by the infringement of the patent right. If the mediation fails, the parties may institute legal proceedings in the people's court in accordance with the Civil Procedure Law of the People's Republic of China.
If, within the said time limit, such proceedings are not instituted and the order is not complied with, the administrative authority for patent affairs may approach the people's court for compulsory execution.
專利侵權糾紛涉及新產品製造方法的發明專利的，製造同樣產品的單位或者個人應當提供其產品製造方法不同於專利方法的證明；
Where any infringement dispute relates to a patent for invention for a process for the manufacture of a new product, any entity or individual manufacturing the identical product shall furnish proof to show that the process used in the manufacture of its or his product is different from the patented process.
涉及實用新型專利的，人民法院或者管理專利工作的部門可以要求專利權人出具由國務院專利行政部門作出的檢索報告。
Where the infringement relates to a patent for utility model, the people's court or the administrative authority for patent affairs may ask the patentee to furnish a search report made by the patent administration department under the State Council.
第五十八條 假冒他人專利的，除依法承擔民事責任外，由管理專利工作的部門責令改正並予公告，
Article 58. Where any person passes off the patent of another person as his own, he shall, in addition to bearing his civil liability according to law, be ordered by the administrative authority for patent affairs to amend his act, and the order shall be announced.
沒收違法所得，可以並處違法所得三倍以下的罰款，沒有違法所得的，可以處五萬元以下的罰款；
His illegal earnings shall be confiscated and , in addition, he may be imposed a fine of not more than three times his illegal earnings and, if there is no illegal earnings, a fine of not more than RMB 50,000 yuan.
構成犯罪的，依法追究刑事責任。
Where the infringement constitutes a crime, he shall be prosecuted for his criminal liability.
第五十九條 以非專利產品冒充專利產品、以非專利方法冒充專利方法的，由管理專利工作的部門責令改正並予公告，可以處五萬元以下的罰款。
Article 59. Where any person passes any non-patented product off as patented product or passes any non-patented process off as patented process, he shall be ordered by the administrative authority for patent affairs to amend his act , and the order shall be announced, and he may be imposed a fine of no more than RMB 50,000 yuan.
第六十條 侵犯專利權的賠償數額，按照權利人因被侵權所受到的損失或者侵權人因侵權所獲得的利益確定；
Article 60. The amount of compensation for the damage caused by the infringement of the patent right shall be assessed on the basis of the losses suffered by the patentee or the profits which the infringer has earned through the infringement.
被侵權人的損失或者侵權人獲得的利益難以確定的，參照該專利許可使用費的倍數合理確定。
If it is difficult to determine the losses which the patentee has suffered or the profits which the infringer has earned, the amount may be assessed by reference to the appropriate multiple of the amount of the exploitation fee of that patent under contractual license.
第六十一條 專(zhuan)利(li)權(quan)人(ren)或(huo)者(zhe)利(li)害(hai)關(guan)係(xi)人(ren)有(you)證(zheng)據(ju)證(zheng)明(ming)他(ta)人(ren)正(zheng)在(zai)實(shi)施(shi)或(huo)者(zhe)即(ji)將(jiang)實(shi)施(shi)侵(qin)犯(fan)其(qi)專(zhuan)利(li)權(quan)的(de)行(xing)為(wei)，如(ru)不(bu)及(ji)時(shi)製(zhi)止(zhi)將(jiang)會(hui)使(shi)其(qi)合(he)法(fa)權(quan)益(yi)受(shou)到(dao)難(nan)以(yi)彌(mi)補(bu)的(de)損(sun)害(hai)的(de)，可(ke)以(yi)在(zai)起(qi)訴(su)前(qian)向(xiang)人(ren)民(min)法(fa)院(yuan)申(shen)請(qing)采(cai)取(qu)責(ze)令(ling)停(ting)止(zhi)有(you)關(guan)行(xing)為(wei)和(he)財(cai)產(chan)保(bao)全(quan)的(de)措(cuo)施(shi)。
Article 61. Where any patentee or interested party has evidence to prove that another person is infringing or will soon infringe its or his patent right and that if such infringing act is not checked or prevented from occurring in time, it is likely to cause irreparable harm to it or him, it or he may, before any legal proceedings are instituted, request the people's court to adopt measures for ordering the suspension of relevant acts and the preservation of property.
人民法院處理前款申請，適用《中華人民共和國民事訴訟法》第九十三條至第九十六條和第九十九條的規定。
The people's court, when dealing with the request mentioned in the preceding paragraph, shall apply the provisions of Article 93 through Article 96 and of Article 99 of the Civil Procedure Law of the People's Republic of China
第六十二條 侵犯專利權的訴訟時效為二年，自專利權人或者利害關係人得知或者應當得知侵權行為之日起計算。
Article 62. Prescription for instituting legal proceedings concerning the infringement of patent right is two years counted from the date on which the patentee or any interested party obtains or should have obtained knowledge of the infringing act.

Where no appropriate fee for exploitation of the invention, subject of an application for patent for invention, is paid during the period from the publication of the application to the grant of patent right, prescription for instituting legal proceedings by the patentee to demand the said fee is two years counted from the date on which the patentee obtains or should have obtained knowledge of the exploitation of his invention by another person.
但是，專利權人於專利權授予之日前即已得知或者應當得知的，自專利權授予之日起計算。
However, where the patentee has already obtained or should have obtained knowledge before the date of the grant of the patent right, the prescription shall be counted from the date of the grant.
第六十三條 有下列情形之一的，不視為侵犯專利權：
Article 63. None of the following shall be deemed an infringement of the patent right:
（一）專利權人製造、進口或者經專利權人許可而製造、進口的專利產品或者依照專利方法直接獲得的產品售出後，使用、許諾銷售或者銷售該產品的；
(l) Where, after the sale of a patented product that was made or imported by the patentee or with the authorization of the patentee, or of a product that was directly obtained by using the patented process, any other person uses, offers to sell or sells that product;
（二）在專利申請日前已經製造相同產品、使用相同方法或者已經作好製造、使用的必要準備，並且僅在原有範圍內繼續製造、使用的；
(2) Where, before the date of filing of the application for patent, any person who has already made the identical product, used the identical process, or made necessary preparations for its making or using, continues to make or use it within the original scope only;
（三）臨時通過中國領陸、領水、領ling空kong的de外wai國guo運yun輸shu工gong具ju，依yi照zhao其qi所suo屬shu國guo同tong中zhong國guo簽qian訂ding的de協xie議yi或huo者zhe共gong同tong參can加jia的de國guo際ji條tiao約yue，或huo者zhe依yi照zhao互hu惠hui原yuan則ze，為wei運yun輸shu工gong具ju自zi身shen需xu要yao而er在zai其qi裝zhuang置zhi和he設she備bei中zhong使shi用yong有you關guan專zhuan利li的de；
(3) Where any foreign means of transport which temporarily passes through the territory, territorial waters or territorial airspace of China uses the patent concerned, in accordance with any agreement concluded between the country to which the foreign means of transport belongs and China, or in accordance with any international treaty to which both countries are party, or on the basis of the principle of reciprocity, for its own needs, in its devices and installations;
（四）專為科學研究和實驗而使用有關專利的。
(4) Where any person uses the patent concerned solely for the purposes of scientific research and experimentation.
為(wei)生(sheng)產(chan)經(jing)營(ying)目(mu)的(de)使(shi)用(yong)或(huo)者(zhe)銷(xiao)售(shou)不(bu)知(zhi)道(dao)是(shi)未(wei)經(jing)專(zhuan)利(li)權(quan)人(ren)許(xu)可(ke)而(er)製(zhi)造(zao)並(bing)售(shou)出(chu)的(de)專(zhuan)利(li)產(chan)品(pin)或(huo)者(zhe)依(yi)照(zhao)專(zhuan)利(li)方(fang)法(fa)直(zhi)接(jie)獲(huo)得(de)的(de)產(chan)品(pin)，能(neng)證(zheng)明(ming)其(qi)產(chan)品(pin)合(he)法(fa)來(lai)源(yuan)的(de)，不(bu)承(cheng)擔(dan)賠(pei)償(chang)責(ze)任(ren)。
Any person who, for production and business purposes, uses or sells a patented product or a product that was directly obtained by using a patented process, without knowing that it was made and sold without the authorization of the patentee, shall not be liable to compensate for the damage of the patentee if he can prove that he obtains the product from a legitimate source.
第六十四條 違反本法第二十條規定向外國申請專利，泄露國家秘密的，由所在單位或者上級主管機關給予行政處分；
Article 64. Where any person, in violation of the provisions of Article 20 of this Law, files in a foreign country an application for a patent that divulges an important secret of the State, he shall be subject to disciplinary sanction by the entity to which he belongs or by the competent authority concerned at the higher level.
構成犯罪的，依法追究刑事責任。
Where a crime is established, the person concerned shall be prosecuted for his criminal liability according to the law.
第六十五條 侵奪發明人或者設計人的非職務發明創造專利申請權和本法規定的其他權益的，由所在單位或者上級主管機關給予行政處分。
Article 65. Where any person usurps the right of an inventor or creator to apply for a patent for a non-service invention-creation, or usurps any other right or interest of an inventor or creator, prescribed by this Law, he shall be subject to disciplinary sanction by the entity to which he belongs or by the competent authority at the higher level.
第六十六條 管理專利工作的部門不得參與向社會推薦專利產品等經營活動。
Article 66. The administrative authority for patent affairs may not take part in recommending any patented product for sale to the public or any such commercial activities.
管理專利工作的部門違反前款規定的，由其上級機關或者監察機關責令改正，消除影響，
Where the administrative authority for patent affairs violates the provisions of the preceding paragraph, it shall be ordered by the authority at the next higher level or the supervisory authority to correct its mistakes and eliminate the bad effects.
有違法收入的予以沒收； Where the circumstances are serious, the persons who are directly in charge and the other persons who are directly responsible shall be given disciplinary sanction in accordance with law.
The illegal earnings, if any, shall be confiscated.
第六十七條 從事專利管理工作的國家機關工作人員以及其他有關國家機關工作人員玩忽職守、濫用職權、徇私舞弊，構成犯罪的，依法追究刑事責任；
Article 67. Where any State functionary working for patent administration or any other State functionary concerned neglects his duty, abuses his power, or engages in malpractice for personal gain, which constitutes a crime, shall be prosecuted for his criminal liability in accordance with law.
尚不構成犯罪的，依法給予行政處分。
If the case is not serious enough to constitute a crime, he shall be given disciplinary sanction in accordance with law.
第八章 附則
Chapter VIII Supplementary Provisions
第六十八條 向國務院專利行政部門申請專利和辦理其他手續，應當按照規定繳納費用
Article 68. Any application for a patent filed with, and any other proceedings before, the Patent Administration Department Under the State Council shall be subject to the payment of a fee as prescribed.
第六十九條 本法自1985年4月1日起施行。
Article 69. This Law shall enter into force on April l, 1985.
